Petroleum Licensing

The petroleum licensing authority for Lincolnshire is Lincolnshire Fire and Rescue who is responsible for ensuring safety at Petrol filling stations and other sites where Petrol is dispensed into the fuel tanks of Internal combustion engines and domestic storage.

The main statutory provisions traditionally covering the licensing of petroleum spirit are:

• Petroleum (Consolidation) Act 1928
• (Transfer of Licence) Act 1936, known as Petroleum (Regulations) Act 1928&1936
• The Dangerous substances and Explosive Atmospheres Regulations 2002.

This legislation controls the mode of storage of petroleum spirit and require a licence to be held by the occupier of the premises where petroleum spirit is dispensed.

The responsible person for premises no longer requiring a Petroleum Spirit Licence, such as paint stores and factory processes are required to conduct a risk assessment and take appropriate measures to reduce any significant risks. HSE ACOP L135 provides guidance.
