Other Types Of Highways Act 1980 Orders – Railways/Schools/SSSI Land/Crime Prevention

Lincolnshire County Council may consider requests for the extinguishment and/or diversion of public rights of way under the following legislation:

  • Sections 118A/119A - Application by the railway operator made on safety grounds
  • Sections 118C/119C* - Application by a proprietor of a school for special order on grounds of protection of pupils and staff
  • Section 119D* - Application by the appropriate conservation body for the diversion certain highways for protection of sites of special scientific interest

* As inserted by the Countryside and Rights of Way Act 2000

Sections 118B and 119B provide for the extinguishment or diversion of rights of way for the purposes of crime prevention in “designated crime areas” only, however, as there are no such designated areas in Lincolnshire County Council’s area, we may not therefore process orders under this legislation.
